Citizens File Referendum Challenge to Herbert’s Edicts!
A Dustup is in the Wind…

From mass incarcerations (aka “lockdowns”) to forced muzzling (aka “facemasks mandates”), Gary “Available Jones” Herbert has gone off-the-rails-crazy.  He and his Quarantine Queen Spencer “Loosey Goosey” Cox are committed to “never let a crisis go to waste.” Herbert and Cox are advantaging themselves and Utah’s Goodfellas by prolonging the panic and by destroying what is left of Utah’s separation of branches and powers … and … even more insidious … destroying individual, economic enterprise.

On Monday, citizens from across the state filed referendum applications with the Lieutenant Governor’s office.  In a nutshell, they argue that Herbert has violated both the Utah Constitution’s separation of powers provisions, as well as state statute, and that while the legislature may willingly attempt to surrender its powers and responsibilities, the “co-equal” and “coextensive” legislative power of the People [somewhat unique to Utah’s Constitution] have not.

The People now demand that Herbert’s de facto legislative actions be checked by referendum, as they would any “law” passed by the legislature.  In other words, if Herbert wants to play at being a one-man legislature, he is subject to the referendum process, just like last year’s referendum on the tax hike bill.

The following “Statement as to Referendum Application(s)” concludes that, 

“… the Governor is acting for an indefinite amount of time as both the chief executive and legislative branches of the State of Utah, in violation of the statutory scheme and their governing constitutional provisions. Therefore, any legislative act carried out by the governor is subject to the Citizen’s legislative power, including, but not limited to, referenda as evidenced by Article I Sec. 2 [of the Utah Constitution]:

“‘All political power is inherent in the people; and all free governments are founded on their authority for their equal protection and benefit, and they have the right to alter or reform their government as the public welfare may require.’

“Consider this your formal notice that all constitutional and legal remedies will be pursued should you fail again to perform your duties.”

Another Referendum Filed Against SL County Council’s COVID Madness

“Available Jones” wasn’t the only target of a Citizen Referendum yesterday.  On August 18, 2020, the Salt Lake County Council voted 6-1 to extend its “emergency declaration” all the way through to 2021.  Also on Monday, local fed up Citizens filed a Referendum.  In their application, they cited the following:

“Also note that any legislative act taken by the county is subject to a referendum.  See Baker v. Carlson (2018), Krejci v. Saratoga Springs (2013), and Carter v. Lehi (2012).

“Please also note that Utah Constitution, Article VI, Section 1, is clear regarding constitutional duties, and the constitutional duties of the council and mayor:

“‘The legal voters of any county, city, or town, in the numbers, under the conditions, in the manner, and within the time provided by statute, may… require any law or ordinance passed by the law making body of the county, city, or town to be submitted to the voters thereof, as provided by statute, BEFORE the law or ordinance may take effect.’ [bold and bold caps added]”

When Non-Essentials Rule

As the US continues its retail slide into oblivion, who benefits?  A commentary on the recent Beirut explosion/bombing by Peter Koenig provides some universally-applicable clues:

“How does endemic corruption cause such a well-targeted blast? …. But who could be interested?  Giant real estate speculators, like banks and other financial institutions / financiers that might want to buy the devastated prime area – seaport, airport and surroundings – for pennies on the dollar and newly develop the destroyed site for business and luxury housing – it’s called privatization of disaster.  Something similar happened in New Orleans after Hurricane Katrina struck the Gulf Coast on August 29, 2005.” [bold added]

Beneficiaries of the privatization of disaster often include real estate speculators and other land grabbers, banks and other financial institutions, bankruptcy grifters and sniffers, lawyers, accountants, medical service providers.

Here in Utah, our homegrown Totalitarian Troika, composed of Kommissars Gary Herbert, Senate President Adams, and House Speaker Brad Wilson, direct monies to their favorite industries, as they did with 500,000+ masks from Communist China destined for unexpecting Utahans.

This Troika (aka “Gang of Three”) also managed to conjure up a bevy of newly-minted insider “service providers.” These new “service providers” now owe their cushy jobs and livelihood to Utah’s Goodfellas.  Freshly-ensconced in government and enterprise, they will be hiding out for decades to come … doing their masters’ bidding … political moles and factotums … Utah’s very own “Deep State – Political Officers.”

All of the foregoing corruption is encouraged by designs straight out of the Communist, Leftist, Marxist, Socialist, Leninist, Stalinist, Maoist playbook.  Too difficult to swallow?  Bet you didn’t think the Nation would go from free to incarcerated in their own homes (aka “locked down”), forcibly muzzled (aka “mandatory facemasks”), with tens-of-millions now economically destitute.

Utah is a floundering, former flagship awash in a sea of hypocrisy, deceit, and “Orwellian Doublethink, Doublespeak, Newspeak.”  Above the waterline, we preach and pontificate our economic preeminence and moral superiority.  But underneath, Utah is a leaky ole,’ barnacle encrusted, derelict garbage scow taking water via a long history of notoriously corrupt conduct that makes our State known — far and wide — as the Affinity Fraud Capital of America.

End of Utah’s Corruption Era?
