Preface:
Throughout this report, keep in mind two defects of our broken legal system that amplify, aggravate, and perpetuate many of the rancorous, unresolved conflicts currently bringing our Nation to its knees:
1. Litigation “Churning.” By “churning,” we mean duplicating, unnecessary casework. “Churning” prolongs the case and provides the opportunity for more attorneys to “pile on,” regardless of the issues, outcomes, and ethics.
2. “Billable Hours.” When litigation is “churned,” law firms and attorneys cash in on a windfall of premeditated, taxpayer-funded profits regardless of the issues, the outcomes, and the ethics. But… these disgusting vermin from the Obama era have all disappeared, right? Everything must be improving under president Donald Trump, yes?
Think again. The Trump regime’s attorney general, William Barr, is continuing the Obama legacy. As examples, AG Barr:
* Defended FBI snipers who murdered Army veteran Randy Weaver’s wife, son, and dog in 1992;
* Favors violent gun confiscations, magazine bans, and other frightening gun controls, and
* Is preparing a frightening pre-crime federal assault on innocent gun owners.
The same deep-state swamp of the Obama regime era is alive and gurgling, with salivating serpents like AG Barr who want nothing more than to “collaborate” with Utah courts for your disarmament.

“Intractable Litigation”

In the past 30 years the process of litigating a case has become time-consuming, inefficient, fractious, and expensive. Much of the direct cause of this phenomenon lies at the feet of the insurance industry. Apparently, insurance case managers decided that they knew more about how to efficiently resolve disputes than the lawyers so they created a process to require fixed hourly rates and bills that were required to reflect an hourly charge to the closest 1/10 of an hour for each task. The top hourly rate the insurance companies would approve was about 50-60% of what responsible lawyers were then charging. This fiat billing system, which if taken literally would fail to allow a responsible law office to operate and pay good people, caused a war between the lawyers and the insurance companies.
In order to generate sufficient income to run their offices, the lawyers started to churn the files, adding junior lawyers and paralegals to each case and having them employ scorched earth discovery tactics deposing every possible witness and looking at every possible document in the case in order to generate sufficient income per case at the low rates to make a go of it.
Soon, this approach became the norm and the litigation process as we know it became a morass rather than an efficient system to resolve disputes. Justice suffered, the cost of litigation rose (to the consternation of the insurance companies) and the average person was priced out of the legal market. This process also fractured the legal market. Lawyers who refused to work for insurance companies gravitated to the corporate world and represented large companies who were sophisticated consumers of legal services and would pay a fair price for their services.
Nevertheless, most people were left with the broken, insurance-based system that we now know, which is expensive and very inefficient. It is a sad situation in which the civil side of the third branch of government currently finds itself.
